Bij erfpacht wordt de grond als het ware verhuurd aan de eigenaar van het pand dat er op staat. De verhuurder, meestal de gemeente maar soms ook een particulier, vraagt dan een jaarlijkse bijdrage aan de eigenaar. Dit wordt canon genoemd. Deze canon is fiscaal aftrekbaar. De meest gebruikelijk vorm van uitgifte is een uitgifte van 50 jaar. Andere vormen komen ook voor.<\/p>\n<h3>Erfpacht voor bepaalde tijd.<\/h3>\n<p>In deze situatie ligt de erfpacht gedurende 50 jaar min of meer vast. De canon wordt jaarlijks aangepast aan de kosten van levensonderhoud en je weet gedurende langere tijd wel waar je aan toe bent. Je kan voor meer zekerheid kiezen door de erfpacht van de nog lopende termijn in \u00e9\u00e9n keer af te kopen. Hou er wel rekening mee dat de prijs van het afkopen niet fiscaal verrekenbaar is met de fiscus, de rente weer wel.<\/p>\n<h3>Resterende looptijd.<\/h3>\n<p>Je wilt een huis kopen met erfpacht maar die loopt binnen 30 jaar af. Dit betekent dat je binnen 30 jaar wordt geconfronteerd met een nieuwe erfpacht waarvan de hoogte op dit moment nog niet bekend is. Dat jij het risico wilt lopen is \u00e9\u00e9n ding. Maar bij de financiering van de woning kan je tegen problemen lopen.<\/p>\n<h3>De bank.<\/h3>\n<p>Geldverstrekkers stellen steeds hogere eisen en kunnen soms eisen dat de hypotheek wordt afgelost binnen de looptijd van de erfpacht. Het argument is dat de bank niet weet met wat voor lasten je wordt opgezadeld na de nieuwe uitgifte. Tot voor kort werd daar relatief gemakkelijk mee omgegaan maar sinds een jaar of twee is er een nieuwe koers.<\/p>\n<h3>Heruitgifte.<\/h3>\n<p>Kan je hier iets mee? Je kunt de betreffende gemeente vragen om een z.g. taxatie waarbij op basis van de uitkomst er een tussentijdse heruitgifte kan worden gedaan. De canon is hoger dan de lopende maar je weet weer voor lange periode waar je aan toe bent.<\/p>\n<h3>Eeuwigdurend afgekocht.<\/h3>\n<p>Zie je deze kreet dan wordt er gedurende de looptijd geen canon geheven. Als de erfpacht eeuwigdurend is afgekocht dan is er in feite dezelfde situatie als wanneer de grond in eigendom wordt uitgegeven, Soms is de termijn nog wel gekoppeld aan het aanwezig zijn van de woning. In dat geval verloopt de afspraak dus wanneer de woning wordt gesloopt.<\/p>\n<h3>Particuliere erfpacht.<\/h3>\n<p>In deze situatie is het dus niet een gemeente die de grond verpacht maar een particulier of bedrijf. Zonder hier nu verder op in te gaan wel een waarschuwing, vrijwel geen enkele financier zal een lening verstrekken om een pand te kopen met particuliere erfpacht.<\/p>\n<h3>Duokoop.<\/h3>\n<p>Dit is een vorm van particuliere erfpacht waarbij een woning wordt verkocht zonder de grond. Doel is om anders niet haalbare woningen binnen het beschikbare budget te brengen. De grond wordt in deze situatie gekocht van de verkopers door de nationale grondbank N.V. die diezelfde grond in erfpacht uitgeeft aan de koper. Voordeel voor de kopers is dat de hypotheek veel lager is maar nadeel is dat er ook een canon moet worden betaald. Bovendien zijn niet alle geldverstrekkers bereid in deze constructie te financieren.<\/p>\n<h3>Obligatoire erfpacht.<\/h3>\n<p>Mocht je deze kreet tegenkomen dan is er het volgende aan de hand. Er zal waarschijnlijk sprake zijn van een appartement waarbij meerdere bewoners dezelfde grond delen. Op verzoek van een belanghebbende is heruitgifte gevraagd van de erfpacht. Maar de nieuwe erfpacht gaat pas in als iedere erfpachter akkoord gaat met de nieuwe canon. Iemand die de oude situatie beter vindt, de canon zal lager zijn en de looptijd korter, gaat niet akkoord met de nieuwe canon. Maar diegene die wel akkoord is\u00a0volgt de nieuwe situatie. Die aparte overeenkomst heet dan obligatoire erfpacht.<\/p>\n<h3>Politiek.<\/h3>\n<p>In de politiek is een kentering zichtbaar om steeds vaker de grond te verkopen aan de erfpachter. Het lijkt er dus op dat over een langere periode erfpacht zal verdwijnen maar een echt duidelijk beleid is er nog niet. Feit is dat erfpacht kopers toch afschrikt. Het wordt als negatief ervaren.<\/p>\n<h3>Graag van dienst.<\/h3>\n<p>Dit stuk is niet meer dan een korte samenvatting over enkele aspecten van erfpacht. Het is onmogelijk en zeker ook niet de bedoeling om alle aspecten te bespreken binnen het kader van ons blog.
